Agreement to Terms

These Terms of Service ("Terms") constitute a binding agreement between you and Wild Mountain Bit Farm ("we", "us", or "our") regarding your use of Wisp — Activity Weather (the "App"). By using the App, you agree to these Terms.

Service Description

Wisp is a mobile application that maps weather conditions to user-configured activities, helping you determine when conditions are favorable for outdoor and weather-sensitive activities. The App provides weather forecasts, activity matching, daily digest notifications, and related features.

Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent.

Account and Device Registration

The App uses device-based identification. You are responsible for maintaining the security of your device. We are not liable for any loss or damage arising from unauthorized access to your device.

Subscriptions

Wisp offers a free tier and premium subscription features. Premium subscriptions are billed through the Apple App Store. Subscription terms:

  • Auto-renewal is enabled by default
  • You may cancel at least 24 hours before the end of the current billing period
  • Refunds are handled through Apple's App Store policies
  • A free trial period may be offered to new subscribers

Acceptable Use

You agree not to:

  • Scrape, crawl, or otherwise extract data from the App
  • Use bots, scripts, or automated tools to interact with the App
  • Reverse-engineer, decompile, or disassemble the App
  • Impersonate any person or entity
  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems

Weather Data Disclaimer

Weather forecasts and activity recommendations provided by the App are for informational purposes only. We do not guarantee the accuracy, completeness, or reliability of any weather data or activity recommendations. You are solely responsible for your own safety when engaging in any outdoor activity. We are not liable for any injuries, damages, or losses resulting from reliance on information provided by the App.

Intellectual Property

The App, including its content, features, and functionality, is owned by Wild Mountain Bit Farm and is protected by copyright, trademark, and other intellectual property laws.

Limitation of Liability

To the maximum extent permitted by law, Wild Mountain Bit Farm shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration under the laws of the State of Arkansas. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
